Open Question: If we signed a contract to buy a house, but the contract doesn’t state “pending financing” are we able to ? Open Question: Could i make it happen?

Hi we both a town house back in 2007 that was $370,000 and we gave a 50 thousand down payment. Now the market is down and we want to buy a house.. but the problem is that we want to get rid of this house because it is a burden. I heard about a short sell and got really interested how does it work? and also will I get my 50 thousand down payment back? please help me peeps thanks! also I do not want to rent out the house i just want to get rid of it without doing forclosure
