You have just purchased a new house. The total monthly payment of $1500 covers both the mortgage repayment and $250 per month for insurance and property taxes. My girlfriend filed chapter 7 about three years ago. In her chapter 7 everything was included but her car. The house was not reaffirmed it was discharged in the bankruptcy. The crazy thing is the bank contacted her and asked her if she would like to modify her mortgage so she can continue to stay in the house. The terms of the modification states very clearly that she has no legal or financial obligation to the house anymore because of the bankruptcy. It also states that sense the house was discharged in Federal Bankruptcy count the bank can no longer come after her if she decide at any point she didn't want to live in the house anymore. It does ask that she give them ample notice when she decides to move so they can secure it and get it get to put on the market.
The modification was the original mortgage monthly amount plus and arrears. Her payment went up about $300 more per month. She called her lawyer and ask him was there anything the bank could do to her if she leaves the house. The lawyer said the bank could foreclose on her in a worst case.
That don't sound right to me, she has papers from the bank clearly stating to terms of her modification. I told her she's renting the house from the bank and no longer is the owner.
The other question is what about the deed to the place its still in her name how do she deal with that?
Any Professional help or and one with first hand knowledge of want to do please help.
NOTE: The mortgage was never rewritten, it shows on her credit report as "DISCHARGED IN BANKRUPTCY" It's been at least 2 years since the chapter 7 was discharged and she still lives in the house.

My neighbor was just notified that due to the large amount of foreclosures in the complex, she and all of the other owners will have to pay an extra $600 every three months on top of their $300 monthly maintenance fees. I was wondering how legal this truly is. The association president has also dipped into the complex's reserves for his own interest. His expenses include paying for the wooded area of the property to be cleared out in order for his son to ride his four-wheeler, building a shed to hold the four-wheelers and other belongings, completely remodeling the clubhouse to his liking and not allowing other residents to use it, and constructing a "beach volleyball area" which was unneeded. In reality the complex is in desperate need of repaving the parking lots and other minor repairs that have been ignored. We are also pretty sure that he remodeled his entire condo with the money as well. There have never been any major community problems to have the reserves spent on and they are almost gone because of the president's personal spending. He is claiming the money is for the $320,000 special assessment fees, but that seems astronomically high.

Lately my mail I send out is getting lost as well as the mail I am set to receive. It is very nerve racking to try to recover lost checks not knowing if somebody else has received it and cashed it. Countless phone calls and affidavits. I am getting irked. This has been happening consecutively lately and it doesn't help to see the mail lady on her phone having a good ol time or the mail man with mail spread all over the place tryna sort it. (Apartment Complex) I just don't know what I can do about this. Most likely who would be the cause of all my mail getting lost?

If i sign a deed does someone need to be present as proof? I am being set up. Please help. Thanks
I didn't know what it was... Basically she told me it was part of the papers i had to sign.... Turns out after we both went over the paperwork and agreed on it.... she changed paperwork and turned it in without my signature but yet the deed was in the paperwork.... So the divorce isn't official but can the deed be? I am still on the mortgage.
Right I am asking... Me and my wife were married... I signed a deed with her during our divorce to give the house over to her....there was no one their to witness it...however i'm still fully on the mortgage? is it my house or completly hers and i'm stuck on the mortgage
Gotcha. I signed a deed of my wife's and i house over to her. No one was present but us. Our divorce is done but i have not heard anything about the deed and i know for a fact i'm still on the mortgage. I guess my question is how do i find out i'm not on the deed if no one was there when i signed it over to her and she won't tell me who she turned it into.
