I have been renting my apartment on a month to month lease for 6 months. I just found out from the township that the Duplex apartment is not registered and is listed as a single family homestead. This makes my apartment illegal. I didn't let on that I have this info.
I saw the letter in our mailbox, so I am positive that the township has sent a letter to my landlord over a week ago about the situation, however my landlord has said nothing to me about the situation.
As far as I understand my landlord can
1. Get rid of me, thus making it a single family dwelling.
2. Bring the property up to code, pass inspection, register the duplex, be reassesed on his property taxes and keep me there. (EXPENSIVE)
OK DOES THE FACT THAT THE DUPLEX IS ILLEGAL MAKE OUR LEASE NULL AND VOID
DO I STILL OWE HIM RENT-CAN I STOP PAYING UNTIL HE MAKES THINGS RIGHT?
WHAT DOES HE HAVE TO DO TO GET RID OF ME? remember we have a month to month lease
DOES HE OWE ME MOVING or other EXPENSES, IF I NEED TO GO?

My lender contacted me in the 11th hour to ask for information on a 4506-T, it was the day before closing, we already have a commitment letter, yet I was told that this would be required.
I have provided all of my W2's and pay stubs.

The back story is that my landlord and I have been having a really hard time with each other. I had to get the city involved after many repairs were never done for the house including a mice problem that had to be taken care of and he has an illegal tenant in the basement who is on my utilities. So the lease is not being renewed for obvious reasons, but also because he wants to sell the house.
I am current with my rent, except for the most recent month for the following reasons:
My tenancy ends on the 14th of Sept, but I wrote on the memo of the check "Aug 15 - Sept 15" (out of habit from having paid the last 11 months from the 15 to the 15th of each month).
My landlord informs me that he's returning the check because of what it says on the memo, even though he signed for it on two different receipts that say Aug 15 - Sept 15, because the "tenancy ends on Sept 14"
I spoke with my lawyer and they told me that if he signed for the check he should cash it and that the memo portion on the check has no legal meaning either.
Well, the landlord sent it back anyway and wrote a big fat VOID across it, asking for a new check with a different amount of money (it's like $50 less than what I normally pay, so I'm guessing he did the math and took ONE day off the rent).
I'm not kicking and screaming over sending less money, but I'm just so fed up with these petty games. The lawyer said there was no reason why the landlord couldn't deposit the check and he is just being difficult and I'm waiting until tomorrow to call and see what to do from here, but I'm asking for advice until then.
What can I legally do since my landlord refused to accept a perfectly deposit-able check that they signed for, and found no legal reason for them to not deposit it, but sent it back? And about the less amount of money, I never signed anything on the lease stating that I will pay less the last month since it's not 30 days. I signed saying that I'd pay the same amount each month until the tenancy is completed.
Any advice is appreciated.

Im trying to help my parents get there mortgage payment lowered. They cant afford to pay for a lawyer or refinace there home. Has anyone done this and succeed in reducing there monthly payments?

Long story short (kind of)...my husband and I are in one of those crappy adjustable rate mortages which is set to go up in January. We have been trying to refinance, but are having horrible luck. Our credit is considered good (even though we do have a bankruptcy on our record) - but we are being told that our loan to home value is what is throwing us off. We need to be refinanced for $180,000 but our home value is falling short of that. I know there are programs out there like "relief programs" but we keep being told we do not qualify because our loan is neither a Freddie Mac or Fannie Mae. Another stickler seems to be the fact that we pay ALL our bills ontime. There are programs out there for people who are behind on their mortgages...which is not our situation. We are current on all our bills. Bankruptcy was discharged over 2 years ago, and we have worked to rebuild our credit. Is there ANY hope for us out there as far as being able to refinance before our mortgage adjusts is January? Oh, and I DO understand that a bankuptcy will stay on our record for 10 years - but according to a few different mortgage brokers, that's not the problem...it's the economy. HELP!
